Arizona Senate Stands Up to the Feds by Passing a Bill that

Arizona is generally viewed as one of the most pro-gun states in the country, especially for its renowned Constitutional Carry law that allows lawful individuals to carry firearms without a permit. 

Arizona continued pushing the envelope on March 3 when the Senate passed a bill, Senate Bill 1328, which declared that federal gun control laws that transgress on “the U.S. or Arizona Constitutions’ right to bear arms as unenforceable.”

According to the Associated Press, SB 1328 also allows for individuals to file lawsuits against enforcing agents who decide to enforce unconstitutional gun control laws.

One provision notes, “Declares an act, law, treaty, order, rule or regulation of the U.S. government that violates the Second Amendment of the U.S. Constitution or Article II, Section 26 of the Arizona Constitution null, void and unenforceable in Arizona.”

Other provisions in SB 1328 include the following:

States that a government entity, agency, bureau, employee or official, or a person working under the authority or orders of a government entity, agency, bureau, employee or official commits an impairment of a citizen’s right to bear arms by enforcing or attempting to enforce an act, law, treaty, order, rule or regulation of the U.S. government that is null, void and unenforceable by this statute.

Allows a government entity, agency, bureau, employee or official, or a person working under the authority of orders of a government entity, agency, bureau, employee or official that commits an impairment of a citizen’s right to bear arms pursuant to this statute to be sued by any citizen in superior court for declarative and injunctive relief, damages and attorney fees.

Arizona is showing the way gun owners should operate given the partisan makeup of the federal government, which Democrats are in control of. As a consequence, no pro-gun legislation will be able to make progress under these circumstances. 

In the meantime, activists should regroup and get active at the state level. That way, they can score wins and build networks that play a crucial role in a right-wing resurgence. All politics begins at the local and state level. In a time when the federal government has grown so large, it wouldn’t hurt to have some decentralization and power devolved to the states in order to keep the federal government in check.
