AUSTIN, TX – We can all agree that 2020 has been a wild year, and of course, with a wild election that’s still going on a month after what used to be called “Election Day.”
While nothing should surprise us at this point, this headline might – the State of Texas sues Georgia, Michigan, Pennsylvania, and Wisconsin over election rules. And Texas is going straight to the top.
Texas Attorney General Ken Paxton, as legal counsel for the State of Texas, filed a lawsuit directly with the U.S. Supreme Court shortly before midnight on Monday challenging the election procedures in Georgia, Michigan, Pennsylvania, and Wisconsin on the grounds that they violate the Constitution.
There are several major factors to the lawsuit filed by Texas:
- Texas argues that these states violated the Electors Clause of the Constitution because they made changes to voting rules and procedures through the courts or through executive actions, but not through the state legislatures.
- Additionally, Texas argues that there were differences in voting rules and procedures in different counties within the states, violating the Constitution’s Equal Protection Clause.
- Finally, Texas argues that there were “voting irregularities” in these states as a result of the above.
In the text of the lawsuit filing, Texas is asking the U.S. Supreme Court to order the states to allow their legislatures to appoint their electors:
“Certain officials in the Defendant States presented the pandemic as the justification for ignoring state laws regarding absentee and mail-in voting.
The Defendant States flooded their citizenry with tens of millions of ballot applications and ballots in derogation of statutory controls as to how they are lawfully received, evaluated, and counted.
Whether well intentioned or not, these unconstitutional acts had the same uniform effect—they made the 2020 election less secure in the Defendant States.
Those changes are inconsistent with relevant state laws and were made by non-legislative entities, without any consent by the state legislatures. The acts of these officials thus directly violated the Constitution.
This case presents a question of law: Did the Defendant States violate the Electors Cla
use by taking non-legislative actions to change the election rules that would govern the appointment of presidential electors? These non-legislative changes to the Defendant States’ election laws facilitated the casting and counting of ballots in violation of state law, which, in turn, violated the Electors Clause of Article II, Section 1, Clause 2 of the U.S. Constitution.
By these unlawful acts, the Defendant States have not only tainted the integrity of their own citizens’ vote, but their actions have also debased the votes of citizens in Plaintiff State and other States that remained loyal to the Constitution.”
It makes sense that Texas approached the Supreme Court directly, since Article III provides that it is the court of first impression on subjects where it has original jurisdiction, such as disputes between two or more states.

The lawsuit also states that the states enacted last-minute changes, skewing the results of the 2020 general election.
Attorney General Paxton also explained further reasoning behind the lawsuit:
“Trust in the integrity of our election processes is sacrosanct and binds our citizenry and the States in this Union together.
Georgia, Michigan, Pennsylvania, and Wisconsin destroyed that trust and compromised the security and integrity of the 2020 election.
The states violated statutes enacted by their duly elected legislatures, thereby violating the Constitution. By ignoring both state and federal law, these states have not only tainted the integrity of their own citizens’ vote, but of Texas and every other state that held lawful elections.
Their failure to abide by the rule of law casts a dark shadow of doubt over the outcome of the entire election.
We now ask that the Supreme Court step in to correct this egregious error.”
Former House Speaker Newt Gingrich blasts ‘crooked politicians running crooked elections’, ‘biased’ internet companies
November 30, 2020
NEW YORK – On New York WABC 770 AM radio’s “The Cats Roundtable” with John Catsimatidis Sunday, November 29th, former House Speaker Newt Gingrich shared a sobering take on the current state of America in the wake of the contested 2020 Presidential election.
On the program, both Gingrich and his host agreed that they were presently “very, very concerned for America.”
Catsimatidis went on to bring up some statements from mutual liberal friends who dismissively claimed “it’s always been that way,” when it came to the question of ballot stuffing.
Gingrich responded:
“Well, look, it hasn’t always been that way…. It’s just not accurate.
“Have we had occasional stolen elections? Sure.
“But the scale of what we’re looking at in five or six different states, the total number of votes involved, the degree to which those who stole the votes are just methodically, you know, ignoring the law and behaving as though they are beyond any reach.”
Gingrich went on to describe politicians in places like Philadelphia, Georgia, and Michigan as “brazen.”
He then criticized the state legislators and governor of Nevada, who he said “basically legalized illegal behavior” by manipulating the law to work against electing President Trump.
Gingrich then took on media and internet manipulation, telling Catsimatidis:
“Not only do you have crooked politicians running crooked elections, but you have crooked or corrupt internet companies deliberately censoring and biasing.
“You have 92% or 93% of the news media deliberately censoring and biasing.”
He went on to say:
“So, you are faced with the greatest challenge to the American people’s ability to govern themselves, I think that we’ve seen probably since 1824 when John Quincy Adams and Henry Clay stole the presidency from Andrew Jackson.
“I think it’s literally that bad. And it’s that bad at every level.”
The more data comes out on vote anomalies that clearly are not legitimate the more it looks like 2020 may be the biggest Presidential theft since Adams and Clay robbed Andrew Jackson in 1824. State legislatures should demand recounts

Gingrich then further explained the effects of censorship, saying:
“So when word does go out, when a Pennsylvania judge stops them from certifying because the corruption is so great, it’s not going to get covered by any of the networks.”
The former House Speaker added:
“When somebody as famous as Rush Limbaugh reports that four of his six tweets in one day were censored, you know, if it can happen to a guy of that authority and that fame, what should the average person expect out of the system?”
Gingrich then framed the issues with corruption in the election as a matter concerning the American people, not President Trump. He said:
“It’s not about Donald Trump. It’s about your right as an American citizen to assume that your vote is sacred.
“To assume that every legal vote will be counted, and that illegal votes will not be counted, because otherwise the illegal votes drown out the legal votes and cheat the legal citizens of their right to representation.
“I never thought it would be this corrupt. But I think it is.”
Newt is right.

Evoking the voter fraud and rigged elections of the Tammany Hall days, Gingrich continued:
“This is precisely the corruption of the big city machines, all the way back to Tammany Hall in the 19th century.
“And now it has been extended to the whole country by a group of left-wing Democrats who have contempt for the law, they have contempt for the average American, and they want power, and they don’t care how much they have to cheat to try to get it.”
The conversation turned to the issue of the Dominion software.
Gingrich pulled no punches, saying:
“You have to ask yourself, how could people be so stupid as to hire a software company which sends the ballots through Barcelona to Frankfurt to be counted? A company which had, as part of its origin, the Venezuelan dictatorship.”
Gingrich went on to discuss the influence of large financial donors such as George Soros and “the Facebook founder,” presumably co-founder Mark Zuckerberg. He said that the pair, in conjunction with the news media, were:
“all gathering together with the political machines to essentially steal the Presidency.”
In answer to a question on the apparent silence on election matters from the likes of the FBI and Attorney General William Barr, Gingrich was very clear on his thoughts on Deep State corruption.
He told Catsimatidis:
“I think part of it is because there really is a Deep State….
“In the Justice Department, I think it was 97% of the donations in 2016 were to Hillary Clinton and 3% were to Donald Trump.
“We know, from what has come out of the FBI, the depth of the criminal behavior, the depth of illegality at the very top of the FBI, and I think it’s very hard to force the bureaucracy to do its job if that means it will hurt liberals.
He added:
“I think that they slow-walk everything.
“And on the other side, I think that they maximize the effort to go after conservatives.”
Gingrich added a chilling prediction, saying that, with the number of corporate lobbyists expected to be involved, a Biden administration is almost sure to be “the most corrupt administration since Harding in 1921.”
He went on to note that the Hunter Biden scandal is “real,” as are the issues of money from China, Russia, and the Ukraine, and that the coverup of such issues is also “real.” As such, he stated:
“All of us have to recognize how serious a problem this is….
“We’re all very concerned for our country.”
