‘This is the big one’: President Trump tweets in support of

WASHINGTON D.C. – The election dispute is not over yet.
In fact, it’s headed to the nation’s highest court, now, with
the support of the Trump Administration and attorney generals from
several states.�

President Trump tweeted Wednesday: 

“We will be INTERVENING in the Texas (plus many other
states) case. This is the big one. Our Country needs a
victory!â€

The lawsuit was filed by the state of Texas against four other
states. It claims those four states violated election law. 

On Tuesday, Texas Attorney General Ken Paxton filed the suit
against Georgia, Michigan, Pennsylvania, and Wisconsin. It asks
that those states be blocked from voting in the electoral
college. 

Now, the four battleground states have until Thursday to
respond. 

In a
press release
, Paxton wrote: 

“The four states exploited the COVID-19 pandemic to justify
ignoring federal and state election laws and unlawfully enacting
last-minute changes, thus skewing the results of the 2020 General
Election. The battleground states flooded their people with
unlawful ballot applications and ballots while ignoring
statutory requirements as to how they were received, evaluated and
counted.â€
 

He goes on to ask the Supreme Court to intervene and correct
“this egregious error.†His statement continues: 

“Trust in the integrity of our election processes is
sacrosanct and binds our citizenry and the States in this Union
together. Georgia, Michigan, Pennsylvania and Wisconsin destroyed
that trust and compromised the security and integrity of the 2020
election. The states violated statutes enacted by their duly
elected legislatures, thereby violating the
Constitution.â€

It is no surprise that President Trump was quick to back the
suit, after his extensive battles with corruption in the voting
process this election. 

He also tweeted about an earlier lawsuit from a Republican
lawmaker in Pennsylvania. It had asked the Supreme Court to stop
the state from certifying its election. Rejected by the justices,
it was a blow to the Trump campaign. 

President Trump posted: 

“This was not my case as has been so incorrectly reported.
The case that everyone has been waiting for is the State’s case
with Texas and numerous others joining. It is very strong, ALL
CRITERIA MET. How can you have a presidency when a vast majority
think the election was RIGGED?â€
 

It appears that Texas’ new attempt to right election wrongs is
providing new hope for justice, and other states have been quick to
show support too. 

Missouri Attorney General Eric Schmitt said Monday that his
state will back the suit. He tweeted: 

“Election integrity is central to our republic. And I will
defend it at every turn. As I have in other cases — I will help
lead the effort in support of Texas’ #SCOTUS filing today.
Missouri is in the fight.â€

Louisiana Attorney General Jeff Landry also issued a statement,
asking for the Supreme Court to consider the case. It reads: 

“Only the U.S. Supreme Court can ultimately decide
cases of real controversy among the states under our Constitution.
That is why the Justices should hear and decide the case which we
have joined representing the citizens of Louisiana.

Furthermore, the U.S. Supreme Court should consider
the most recent Texas motion, which contains some of the same
arguments.

Louisiana citizens are damaged if elections in other states
were conducted outside the confines of the Constitution while we
obeyed the rules.â€

Alabama Attorney General Steve Marshall tweeted a written
statement of support as well. It says: 

“That decision will instruct me as to how the State
of Alabama will proceed in our fight to ensure election integrity.
The unconstitutional actions and fraudulent votes in other states
not only affect the citizens of those states, they affect the
citizens of all states — of the entire United States.

Every unlawful vote counted, or lawful vote uncounted,
debases and dilutes citizens’ free exercise of the
franchise.â€

Arkansas Attorney General Leslie Rutledge said she supports
Texas’ motion too. She tweeted Tuesday:  

“I have determined that I will support the motion by the
State of Texas in all legally appropriate manners.â€

State of Texas sues Pennsylvania, Georgia, Wisconsin and Michigan,
at the Supreme Court over the election

AUSTIN, TX – We can all agree that 2020 has
been a wild year, and of course, with a wild election that’s
still going on a month after what used to be called “Election
Day.†

While nothing should surprise us at this point, this headline
might –
the State of Texas sues
Georgia, Michigan, Pennsylvania, and
Wisconsin over election rules.  And Texas is going straight to the
top.

Texas Attorney General Ken Paxton, as legal counsel for the
State of Texas, filed a lawsuit directly with the U.S. Supreme
Court shortly before midnight on Monday challenging the election
procedures in Georgia, Michigan, Pennsylvania, and Wisconsin on the
grounds that they violate the Constitution.

There are several major factors to the lawsuit filed by
Texas:

  • Texas argues that these states violated the Electors Clause of
    the Constitution because they made changes to voting rules and
    procedures through the courts or through executive actions, but not
    through the state legislatures.
  • Additionally, Texas argues that there were differences in
    voting rules and procedures in different counties within the
    states, violating the Constitution’s Equal Protection
    Clause.
  • Finally, Texas argues that there were “voting
    irregularities†in these states as a result of the above.

In the text of the lawsuit filing, Texas is asking the U.S.
Supreme Court to order the states to allow their legislatures to
appoint their electors:

“Certain officials in the Defendant States presented
the pandemic as the justification for ignoring state laws regarding
absentee and mail-in voting.

The Defendant States flooded their citizenry with tens
of millions of ballot applications and ballots in derogation of
statutory controls as to how they are lawfully received, evaluated,
and counted.

Whether well intentioned or not, these unconstitutional
acts had the same uniform effect—they made the 2020 election less
secure in the Defendant States.

Those changes are inconsistent with relevant state laws
and were made by non-legislative entities, without any consent by
the state legislatures. The acts of these officials thus directly
violated the Constitution.

This case presents a question of law: Did the Defendant
States violate the Electors Cla

use by taking non-legislative actions to change the
election rules that would govern the appointment of presidential
electors? These non-legislative changes to the Defendant States’
election laws facilitated the casting and counting of ballots in
violation of state law, which, in turn, violated the Electors
Clause of Article II, Section 1, Clause 2 of the U.S.
Constitution.

By these unlawful acts, the Defendant States have not
only tainted the integrity of their own citizens’ vote, but their
actions have also debased the votes of citizens in Plaintiff State
and other States that remained loyal to the
Constitution.â€

It makes sense that Texas approached the Supreme Court directly,
since Article III provides that it is the court of first impression
on subjects where it has original jurisdiction, such as disputes
between two or more states.

The lawsuit also states that the states enacted last-minute
changes, skewing the results of the 2020 general election.

Attorney General Paxton also explained further reasoning behind
the lawsuit:

“Trust in the integrity of our election processes is
sacrosanct and binds our citizenry and the States in this Union
together.

Georgia, Michigan, Pennsylvania, and Wisconsin destroyed
that trust and compromised the security and integrity of the 2020
election.

The states violated statutes enacted by their duly
elected legislatures, thereby violating the Constitution. By
ignoring both state and federal law, these states have not only
tainted the integrity of their own citizens’ vote, but of Texas
and every other state that held lawful elections.

Their failure to abide by the rule of law casts a dark
shadow of doubt over the outcome of the entire
election.

We now ask that the Supreme Court step in to correct
this egregious error.†
